The Constitutional Court allowed double lawlessness by its decision to suspend the President of the Republic of Moldova legitimately elected by direct vote of citizens from office: it nullified the President’s attempt to stop a serious violation of the law, and allowed that this violation is committed by the so-called acting president. The Head of State wrote this on his page in the social network, commenting on the decision of the court.
“The Constitutional Court completely disregarded the legitimate arguments that I gave in support of my decision, and in this connection I want to recall the following.
1. Why cannot Mrs. Sylvia Radu be appointed Minister of Health, Labor and Social Protection.
Article 8, paragraph 4, of the Law on the public office and the status of a civil servant reads: “In order to hold a top managerial public office, a person must meet the following requirements: “(a) To comply with the conditions provided for in Article 27; b) have higher education, confirmed by a diploma of a licentiate or an equivalent education document; c) have worked in the specialty / profile of the relevant public office for at least five years; d) have at least two years of managerial experience “. These conditions are put forward for any candidate for any public office, and it would be strange if the minister responsible for this or that area, and this post is much higher than the position of civil servant, would not meet the minimum requirements put for his subordinate.
2. In the case of Nikolai Chubuk, proposed to the post of Minister of Agriculture, Regional Development and Environment, it should be noted that it does not meet the criteria for incorruptibility. Representatives of the authorities are well aware of the criminal violations committed by him, but nevertheless insist on his appointment to such an important post.
I regret that instead of stopping serious violations committed by the authorities, the Constitutional Court gives a “green light” to its continuation. This once again raises big questions about professionalism and independence of the Constitutional Court judges.
Representatives of the authorities and the institutions they control simply do not realize the seriousness of their actions and its consequences. But sooner or later they will have to answer for all these violations. They will respond with all the rigor of the current law, which they now shamelessly violate, promoting their narrow party interests,” the President said.
