Moldovan top court declares unconstitutional judges' checking by Intelligence and Security Service

The Constitutional Court (CCM) today declared unconstitutional the judges’ checking by the Intelligence and Security Service (SIS).  

The provisions are included in the law on verification of titulars and candidates for public offices.

CCM’s ruling is final, cannot be subjected to any appeal, enters into force on the day of its adoption and is published in Moldova’s Official Journal (Monitorul Oficial).

The decision was pronounced following a request regarding a case of magistrate Domnica Manole, against whom this practice was applied.

At the same time, the Supreme Court of Justice (CSJ) has earlier informed that the practice of judges’ checking by SIS was unconstitutional, as this does not meet the principles of human rights.

In late last August, CSJ admitted a request of Domnica Manole’s lawyers on the establishment by CCM of the constitutionality of judges’ verification by SIS.

The request came after, on 4 July 2017, the Superior Council of Magistracy had ruled that Domnica Manole was incompatible with the office of judge. The decision was taken following a note by SIS.
